Towards new family law. Reflections from the practice of law

Abstract

The development of family law is analysed in this article. The original positions based on the principles of public order have given way to contents based on the equal rights of spouses and consensus as a form of regulation of relationships during the relation and at its termination. The idea of a family based both on blood or affinity relations, considering both married and unmarried couples, is also reviewed. The position of lawyers must be close to people, their development and social evolution, In order to do so, a change is needed in the profession that emphasizes counselling and agreement, while defending public and private interests. The firm belief that adequate solutions can be offered to citizens if their matters are focussed in a cooperative way underties this proposal.
